“Election Integrity Watchdog Skewers Michigan Gubernatorial Candidate For Allowing Illegals To Vote”

The Fair Election Fund, a nonpartisan election integrity organization, is launching a new initiative to evaluate the performance of secretaries of state in key battleground states, beginning with Michigan’s Jocelyn Benson. According to a report obtained by the Daily Caller, the group has issued a 51-page assessment of Benson’s handling of recent elections, assigning her a grade of “D.”
The report, which focuses primarily on election administration in the lead-up to the 2024 presidential contest, argues that Benson’s actions have diminished voter confidence in Michigan. It cites her own admission that at least 15 non-citizens voted in the previous election and outlines what the organization views as multiple violations of election law.
The Fair Election Fund alleges that Benson failed to enforce existing election statutes, prompting a series of lawsuits from election officials, citizens, and advocacy groups. According to the report, courts have on several occasions found Benson’s actions to be unlawful.
One example cited is a Michigan court’s decision to strike down Benson’s guidance instructing clerks to presume the validity of absentee ballot signatures. In June 2024, Michigan Court of Claims Judge Christopher Yates ruled the guidance violated state law, describing it as “a foul under Michigan law.” The report notes this was not the first instance of such a directive from Benson, referencing similar legal challenges in 2020 and 2022.
The watchdog group also highlighted concerns over the integrity of Michigan’s voter registration rolls. The report notes that Benson initially denied claims that voter rolls were bloated but later acknowledged, in 2020, that they lacked “sufficient comprehensive efforts” to ensure accuracy. In March 2024, the Republican National Committee (RNC) filed a lawsuit alleging noncompliance with the National Voter Registration Act; however, the case was dismissed due to procedural issues. The RNC is currently appealing the decision.
Another case cited involves a Chinese national who allegedly voted in the 2024 election. According to the Fair Election Fund, the individual, a 19-year-old University of Michigan student, registered using a student ID and falsely claimed U.S. citizenship. He later contacted local officials to withdraw his ballot, prompting charges from Michigan authorities. The organization claims this incident reveals deficiencies in the state’s voter verification safeguards.
The report also critiques Benson’s opposition to the federal “Safeguard American Voter Eligibility (SAVE) Act,” recently passed in the House of Representatives. The legislation would require voters to present proof of U.S. citizenship at the polls. Benson expressed concerns over the measure, describing the issue of non-citizen voting as one that should be approached “with a scalpel, not a sledgehammer.”
Benson, who recently announced her candidacy for governor of Michigan, has not yet publicly responded to the Fair Election Fund’s report. Her office did not return a request for comment by the time of publication.
